By creating an account or using the Kiraye platform, you agree to these Terms. If you do not agree, do not use the platform. These Terms apply to both property owners and tenants — additional obligations specific to each role are called out in their respective sections.
Habitek Management Group ("Habitek," "we," "us," or "our"), a DBA of Pothrini Inc., provides the Kiraye platform — a property management software-as-a-service that allows property owners to manage their portfolios and tenants to access lease information, submit maintenance requests, and pay rent.
We are a software platform, not a licensed property management company in all jurisdictions. Use of Kiraye does not constitute the provision of legal, financial, tax, or property management advice.
You must provide accurate information when creating an account. You are responsible for maintaining the security of your credentials and for all activity that occurs under your account. Notify us immediately at pothrini01@gmail.com if you suspect unauthorized access.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for more than 24 months.
You retain full ownership of all documents and data you upload to Kiraye. By uploading content, you grant Habitek a limited, non-exclusive license to store, display, and process that content solely for the purpose of providing you with the platform's features.
You are solely responsible for the content you upload. This includes ensuring you have the legal right to store documents that contain third-party personal information (such as a tenant's personal details in a lease). Habitek acts as a data processor for your uploaded content — you remain the data controller and bear responsibility for compliance with applicable privacy laws regarding that content.
When you add tenant records, upload leases, or share documents with tenants through the platform, you warrant that:
The AI document scanning features (Bill Scanner, Lease Scanner, mortgage interest extraction) process document content to extract structured data. You must review and confirm all AI-extracted information before it is saved. Habitek does not guarantee the accuracy of AI-extracted data and is not liable for errors in extracted figures.
Financial reports, tax summaries, and CPA-ready exports generated by Kiraye are for your reference only and do not constitute tax advice. Consult a licensed tax professional before filing.
Rent collection through Kiraye is powered by Stripe. By enabling payment collection, you agree to Stripe's Terms of Service and Connected Account Agreement. Habitek does not hold, transfer, or have access to funds in transit — all payment processing is handled directly by Stripe.
As a tenant, your account is created in connection with a rental property managed through the platform. Your landlord (the property owner) is responsible for the accuracy of your lease data, rent amount, and any documents shared with you.
Rent payments you make through the platform are processed by Stripe. Payment confirmations are binding. Contact your landlord directly for disputes about rent amounts or lease terms — Habitek is not a party to your lease agreement.
You may request deletion of your Kiraye account at any time. Note that your landlord may retain lease records independently of the platform.
You may not use Kiraye to:
Kiraye offers free and paid subscription tiers. Paid plans are billed monthly through Stripe. You may cancel at any time; your access continues until the end of the billing period. We do not offer refunds for partial periods.
We reserve the right to change pricing with 30 days' notice to existing subscribers. Customers on admin-managed plans (price set by Habitek directly) are subject to individually agreed pricing.
The Kiraye platform, its design, code, and AI models are the intellectual property of Habitek Management Group / Pothrini Inc. You receive a limited, non-transferable license to use the platform for your own property management purposes. You may not reproduce, distribute, or create derivative works from the platform.
You retain all rights to your own data and uploaded documents.
THE KIRAYE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. HABITEK DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF SECURITY VULNERABILITIES. YOUR USE OF THE PLATFORM IS AT YOUR OWN RISK.
We make reasonable efforts to maintain uptime and data integrity but do not guarantee any specific service level.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HABITEK MANAGEMENT GROUP AND POTHRINI INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOSS OF REVENUE, OR UNAUTHORIZED ACCESS TO YOUR DOCUMENTS — ARISING FROM YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claim arising from use of the platform shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
You agree to indemnify and hold harmless Habitek Management Group, Pothrini Inc., and their officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the platform; (b) content you upload; (c) your violation of these Terms; or (d) your violation of any third party's rights, including your tenants' privacy rights.
Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
We reserve the right to modify, suspend, or discontinue any part of the platform with reasonable notice. We will not be liable to you for any modification, suspension, or discontinuation of the service.
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the platform shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under the American Arbitration Association rules.
You waive any right to participate in a class-action lawsuit or class-wide arbitration against Habitek.
We will notify registered users by email at least 14 days before material changes to these Terms take effect. Continued use of the platform after that date constitutes acceptance of the updated Terms.
